1. Introduction

Welcome to Pana Productions. These Terms and Conditions govern your use of our website located at www.panaproductions.com.np and any services provided by Pana Productions, including but not limited to video production, event coverage, digital marketing, and related creative services.

By accessing our website or engaging our services, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.

2. About Us

Pana Productions is a full-service creative production house based in Thapathali, Kathmandu, Nepal. We operate through two specialized wings, Pana Events and Pana Films and also provide comprehensive digital marketing solutions to clients across Nepal.

3. Services

Pana Productions offers the following services:

• Video production including weddings, events, and cultural ceremonies
• Commercial and advertisement video production
• Music video production
• Corporate and business video production
• Short films, documentaries, and brand films
• Drone videography
• Digital marketing including social media management, paid advertising, SEO, and content creation
• Pre-production, post-production, and editing services

The scope, timeline, and deliverables of each service will be confirmed and agreed upon in writing before any project commences.

4. Bookings and Confirmations

All bookings are subject to availability. A project or event date is only confirmed once a written agreement or booking confirmation has been issued by Pana Productions and the required advance payment has been received.

Verbal agreements, inquiries, or informal communications do not constitute a confirmed booking.

5. Payments

A non-refundable advance payment is required to confirm any booking. The amount will be communicated at the time of booking and specified in your project agreement.

The remaining balance is due on or before the date of delivery of the final product unless otherwise agreed in writing.

Pana Productions reserves the right to withhold delivery of final files until full payment has been received.

Late payments may be subject to a delay in delivery or additional charges as outlined in your project agreement.

6. Cancellations and Rescheduling

If a client wishes to cancel a confirmed booking, the advance payment is non-refundable under all circumstances.

If a client requests rescheduling, Pana Productions will make reasonable efforts to accommodate the new date, subject to availability. Rescheduling requests must be made in writing at least 14 days before the scheduled date.

If Pana Productions is unable to fulfill a confirmed booking due to unforeseen circumstances, the client will be notified as soon as possible and any advance payments made may be refunded or transferred to a rescheduled date at the client's discretion.

7. Delivery of Final Products

Pana Productions will deliver final video and photo files within the timeline agreed upon in your project agreement. Typical delivery timelines are communicated clearly before the project begins.

Files will be delivered via a secure online link, cloud storage, or physical media as agreed. Pana Productions is not responsible for any delays caused by circumstances beyond our control, including technical failures, natural disasters, or other force majeure events.

8. Revisions and Edits

The number of revisions included in each project will be specified in the project agreement. Any revisions requested beyond the agreed scope may be subject to additional charges.

Revision requests must be submitted in writing within 7 days of receiving the draft. Requests submitted after this period may be treated as a new project.

9. Intellectual Property and Ownership

Upon full payment of all outstanding amounts, the client receives a license to use the final delivered content for personal or commercial purposes as agreed in the project scope.

Pana Productions retains the right to use any produced content, including photos and videos, for portfolio, promotional, and marketing purposes unless the client has explicitly requested otherwise in writing prior to the commencement of the project.

All raw footage, unedited files, and project source files remain the property of Pana Productions unless otherwise agreed in writing.

10. Client Responsibilities

Clients are responsible for providing accurate and complete information required for the project, including event details, brand guidelines, scripts, and any other relevant materials.

Clients must ensure that all necessary permissions, licenses, and consents are obtained for any third-party content, locations, talent, or music included in the project. Pana Productions is not liable for any legal issues arising from the use of third-party materials provided by the client.

11. Limitation of Liability

Pana Productions will make every reasonable effort to deliver high-quality results as agreed. However, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of revenue, loss of data, or reputational damage.

Our total liability to any client shall not exceed the total amount paid by the client for the specific project in question.

12. Force Majeure

Pana Productions shall not be held liable for any failure or delay in performance of services caused by circumstances beyond our reasonable control, including natural disasters, government restrictions, pandemics, power failures, or any other event outside our control.

13. Confidentiality

Both parties agree to keep confidential any sensitive information shared during the course of a project. Pana Productions will not disclose any client information to third parties without prior written consent, except as required by law.

14. Website Use

The content on our website, including text, images, videos, logos, and graphics, is the property of Pana Productions and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, or use any content from our website without prior written permission from Pana Productions.

15. Third-Party Links

Our website may contain links to third-party websites for reference or informational purposes. Pana Productions does not endorse or take responsibility for the content, privacy practices, or services of any third-party websites.

16. Changes to These Terms

Pana Productions reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after any changes constitutes your acceptance of the revised terms.

17. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Nepal. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
